On additional measures to stimulate attraction of direct private foreign investments

In order to further improve the investment climate in the country, to broadly attract private foreign direct investment for the implementation of privatization, modernization, technical re-equipment and reconstruction of production programs, create new jobs in the labor-surplus regions of the republic, as well as provide reliable legal protection and guarantees for foreign investors:

1. For enterprises established with the attraction of direct foreign investments and specialized in the production of products (provision of services) in economic sectors according to the list in accordance with the appendix, specific features of applying incentives for individual taxes in the manner prescribed by the Tax Code of the Republic of Uzbekistan are provided for the following volumes of direct private foreign investments:

from 300 thousand US dollars to 3 million US dollars — for a period of 3 years;

over 3 million US dollars up to 10 million US dollars — for a period of 5 years;

where it exceeds 10 million US dollars — for a period of 7 years.

2. It shall be established that incentives for individual taxes provided for by the Tax Code of the Republic of Uzbekistan, specified in Clause 1 of this Decree, shall be applied when locating the specified enterprises in all cities and settlements of the Republic, except for the city of Tashkent and districts and cities of categories 1–3 of the Tashkent region. Such territorial restriction shall not apply to enterprises operating in the fields of tourism and waste management.

3. The Ministry of Investment, Industry, and Trade of the Republic of Uzbekistan shall be charged with the task of determining whether enterprises attracting direct private foreign investments belong to the economic sectors specified in the appendix to this Decree.

5. In the event of termination of the activities of an enterprise that has received benefits in accordance with paragraph 1 of this Decree, earlier than one year after the expiration of the period for which they were granted, the repatriation of profits and the export of capital of a foreign investor abroad is carried out only after reimbursement to the budget of the amounts of granted benefits.

9. The Ministry of Justice of the Republic of Uzbekistan together with the interested ministries and departments within one month to submit proposals to the Cabinet of Ministers on amendments and additions to the existing legislative acts in connection with the adoption of this Decree.

10. Control over the implementation of this Decree is entrusted to the First Deputy Prime Minister of the Republic of Uzbekistan R.S. Azimova.
